In the article 15 of Afghanistan Trademark Registration Law has been regulated assignment and transfer of a registered trademark as follows:
“Trademarks are transferable and the transfer shall be valid if recorded separately with the Central Registration pursuant to these Articles and their relevant regulations.”
Trademark license, which is different from assignment, is an agreement in which a trademark owner (the “licensor”) permits someone else (“the “licensee”) to use the licensor’s trademark in connection with specific products or services. The unlicensed use of a registered trademark is illegal and punishable under article 27 of the law.
The requirement for the above matters is a power of Attorney duly legalized up to the Afghanistan Consulate, document showing the assignment agreement issued by the local competent authority and the original registration certificate or last renewal certificate of the trademark for endorsement of the concerned recordal.
