What is Registrable as a Trademark

Article two and three of Afghanistan Trademark Registration Law defined trademark as follows:

Trademarks consist of (one or more) names, words, signatures, letters, figures, drawings, symbols, titles, seals, pictures, inscriptions, advertisements or packs or any other mark or a combination thereof.

Use of each one of the trademarks specified in article two is optional except for those cases where the Ministry of Commerce and Industry or the Central Registration Office has made their use mandatory.”

According article six of Afghanistan Trademark Registration Law there are some restriction which may not be used or registered as trademarks like national flag, marks of official organizations such as Red Crescent, any marks repugnant to chastity, morality and public order.
