Renewal
Trademark protection is for a limited period of time. Once this period has expired, the trademark must be renewed by the holder in order to maintain its validity. The protection of trademark has been regulated in article 18 of Afghanistan Trademark Law as follows:
“A registered trademark shall be valid for a period of ten years, which may, upon request by the owner, be extended for successive 10-year periods. The owner of the trademark shall, within six months prior to expiry of the period submit application for renewal.”
Within this period trademark renewal registration application can be filed. The requirement for renewal registration is a power of attorney duly legalized up to the Afghanistan Consulate, a scanned copy of the original registration certificate, or the last renewal certificate of the trademark.
